Terms of use of the website of Dinvest

1. Scope of application
These terms of use apply to the use of the website of Dinvest Bewirtschaftung AG (hereinafter Dinvest) at dinvest.ag (hereinafter website). By accessing the website, you agree to these terms of use.
2. Access to the website
The website and its content are available exclusively for personal and non-commercial use. Dinvest reserves the right to restrict or interrupt access to the website without prior notice, in particular for maintenance purposes or technical adjustments.

In order to access certain functions or content of the website, in particular our tenant and landlord portals, it may be necessary to create a personal and non-transferable user account. You are responsible for keeping your access data (such as username and password) strictly confidential and for preventing access by third parties. If you become aware or suspect that your access data has been disclosed without authorisation or that your account has been compromised, you are obliged to inform Dinvest immediately. Dinvest assumes no liability for unauthorised access or use of your user account by third parties.
You warrant that all information provided during registration is accurate and complete and undertake to keep it up to date throughout the period of use.
Dinvest reserves the right to temporarily block or permanently delete user accounts at any time without prior notice if:
• there is a breach of these terms of use, in particular if the content of the website is misused, reproduced, passed on to third parties or used for unauthorised commercial purposes;
• false or misleading information was provided during registration or while using the user account;
• the security of the user account or the website is compromised, e.g. by hacking attempts, phishing, unauthorised access or other manipulation;
• repeated violations of the website's rules of conduct or applicable laws and regulations are detected;
• there is reasonable suspicion of misuse of the user account, such as unauthorised access by third parties or use that violates the interests of Dinvest, other users or third parties;
• the user account remains inactive for an extended period of time and does not respond to notifications from Dinvest
In such a case, Dinvest will, if reasonable, inform the user concerned in advance. However, if Dinvest believes that access to your user account is harmful to the website, other users or third parties or violates legal regulations or official instructions, access may be blocked or deleted without prior notification.

4. Intellectual property
The contents of the website, including texts, graphics, logos, videos and other materials, are in particular protected by copyright and are the property of Dinvest or its partners. You may browse the website and reproduce extracts from it for your personal use by printing or downloading, whereby any commercial use is excluded. 6. Exclusion of liability
Irrespective of the basis of liability (contractual, non-contractual, etc.), Dinvest shall be liable without limitation for damages caused by Dinvest itself intentionally or through gross negligence, as well as for personal injury. Any further liability on the part of Dinvest is expressly excluded.

Dinvest allows you to add hyperlinks from the website to your webpage(s), subject to the following conditions:
• The placement of hyperlinks must in no way impair or exploit the reputation or integrity of Dinvest.

These terms of use are subject to Swiss law. The exclusive place of jurisdiction is the registered seat of Dinvest.
